An Act of Parliament that governs the procedure courts follow when handling civil cases in Uganda. It covers the filing of suits, service of summons, pleadings, hearing of evidence, and enforcement of judgments.

Civil Procedure Act

The Civil Procedure Act (Cap 282) is the main law governing civil cases in Uganda’s High Court and magistrates courts. It sets out how lawsuits are filed, heard, decided, enforced, and challenged on appeal. It applies to ordinary civil disputes involving money, property, contracts, or compensation, but not to criminal matters. The Act also states the rights and duties of parties, witnesses, judgment debtors, and court officers.
<h3>Where the Act Applies and Basic Terms</h3>
The Act applies to civil proceedings in the High Court and in magistrates courts. It defines key legal terms such as advocate, court, judge, decree, judgment, order, decree holder, and judgment debtor. Special powers and procedures under other laws continue to apply unless this Act specifically says otherwise.
<h3>Jurisdiction and Where to File a Suit</h3>
Courts must hear every civil suit unless a law expressly or by implication bars them from doing so. A court cannot hear a suit whose value exceeds its ordinary pecuniary jurisdiction unless another law provides otherwise. Filing rules depend on the type of claim:
<ul><li>Suits about immovable property are filed where the property is situated.</li><li>Suits for compensation for harm to a person or movable property may be filed where the wrong happened or where the defendant lives, carries on business, or works for gain.</li><li>Other suits are filed where the defendant resides, carries on business, or works, or where the cause of action arises wholly or partly.</li><li>If the same immovable property falls in different court areas, you may file where any part lies if the court can hear the full value.</li><li>If you file in the High Court a suit that could have been brought in a magistrates court and recover less than four hundred shillings, you will not get costs; if you recover between four hundred shillings and the magistrates court limit, you only get magistrates court level costs unless a High Court judge certifies or orders otherwise.</li></ul>
An objection to the place of filing must be raised in the first court; otherwise it cannot be raised on appeal unless there was a failure of justice. The High Court may transfer cases between magistrates courts or withdraw and transfer cases.
<h3>Bars to Re-Litigation and Foreign Judgments</h3>
If the same matter is already directly and substantially in issue in an earlier pending suit between the same parties under the same title, the court must stay the later suit. A pending foreign suit does not stop a Ugandan court.
<ul><li>Res judicata: A final decision by a competent court between the same parties bars re-litigation of matters that were or could have been raised.</li><li>A party cannot file a further suit on the same cause of action if the rules bar it.</li><li>A foreign judgment is generally conclusive, but not if the foreign court lacked jurisdiction, the case was not decided on merits, the judgment misapplies international law or refuses to apply Ugandan law where required, or was obtained by unfair proceedings or fraud, or supports a claim based on a breach of Ugandan law.</li><li>A certified copy of a foreign judgment is presumed to come from a court of competent jurisdiction.</li></ul>
<h3>Commencing a Suit, Service, and Evidence</h3>
A suit must be instituted by following the prescribed rules. The defendant must be served with court papers and then enter an appearance and answer. Documents may be sent for service through a court in another district.
Courts can order discovery, interrogatories, admission of documents or facts, inspection, production of evidence, and affidavit evidence. They can also issue summonses to witnesses to give evidence or produce documents.
<ul><li>A person summoned who fails to attend may be arrested by warrant, have property attached and sold, be fined up to UGX 10,000,000, or be required to provide security for appearance.</li></ul>
<h3>Judgment, Interest, and Costs</h3>
After hearing a civil case, the court pronounces judgment and then issues a decree. If the defendant does not appear, the court may give judgment in default. The court may refuse an unconscionable interest rate and order a just rate. For money decrees, the court may add interest for the period before and during the suit, and post-judgment interest. If the decree is silent on post-judgment interest, it is treated as six percent per year.
The court decides who pays costs and how much. Typically the losing party pays, but the court may order otherwise for good reason. The court may also order interest on costs up to six percent per year. Execution rules for decrees also apply to orders.
<h3>Execution of Decrees and Court Orders</h3>
A decree may be executed by the court that passed it or by another court to which it is transferred. The executing court acts as if it passed the decree, and must certify the outcome. Questions about execution, discharge, or satisfaction are decided by the executing court, not by a separate suit.
<ul><li>You cannot obtain fresh execution, except for injunctions, more than 12 years after the decree, unless the judgment debtor prevented execution by fraud or force within the previous 12 years.</li><li>If the judgment debtor dies before full satisfaction, the decree may be executed against the legal representative or a person who intermeddled with the estate, but only up to the value of the deceased’s property received and not duly disposed of.</li><li>Execution may be by delivery of property, attachment and sale, sale without attachment, attachment of debts, arrest and detention, appointment of a receiver, or any other manner the relief requires.</li><li>Private transfer or delivery of attached property is void as against claims enforceable under the attachment.</li><li>Before immovable property is sold in execution, the duplicate certificate of title or a special certificate must be lodged with the court; the purchaser’s title is subject to land registration laws and becomes absolute only after full payment.</li><li>If several courts attach the same property, the highest grade court or the first attaching court of equal grade takes over and decides claims.</li><li>When assets are held and multiple decree holders have lodged execution applications, the court deducts realisation costs and distributes remaining assets in the order the applications were lodged.</li><li>If a person is resisted or obstructed in obtaining possession of immovable property under a decree, the court may detain the obstructer for up to 30 days and order possession be given.</li><li>The High Court may order immediate execution of a decree before costs are taxed, except the costs portion.</li><li>A transferee of a decree takes it subject to any legal or equitable defences that could have been raised against the original decree holder.</li></ul>
<h3>Arrest, Detention, and Exemptions in Execution</h3>
A judgment debtor may be arrested at any hour and on any day, but no dwelling house may be entered after sunset and before sunrise. An outer door may be broken only if the debtor occupies the house and refuses access; women in customary seclusion must be given notice and time to withdraw. Detention limits are:
<ul><li>Up to six months if the decree orders payment of more than one hundred shillings; otherwise up to six weeks.</li><li>Early release applies if the amount is paid, the debt is satisfied, the applicant requests release, or subsistence allowance is not paid.</li><li>A released debtor remains liable but cannot be rearrested under the same decree.</li><li>Monthly subsistence allowances for judgment debtors may be set by the Minister by statutory instrument.</li></ul>
Some property is exempt from attachment and sale, including necessary clothing and cooking vessels, beds and bedding for the debtor and family, certain tools and livestock up to 500 shillings, the right to sue for damages, pensions, and salary portions below specified monthly limits. Women under customary seclusion are exempt from personal appearance but not from civil arrest. Judicial officers, parties, advocates, and witnesses going to or returning from court are generally exempt from civil arrest under this Act.
<h3>Special Types of Suits and Proceedings</h3>
The Act also covers:
<ul><li>Interpleader suits by a person holding money or property claimed by two or more others.</li><li>Arbitration referrals in civil suits, which follow prescribed rules.</li><li>Special cases stated for the court’s opinion by written agreement.</li><li>Public nuisance suits by the Attorney General or by two or more persons with the Attorney General’s written consent.</li><li>Suits concerning public charitable or religious trusts by the Attorney General or interested persons with consent; remedies include removal or appointment of trustees, accounts, and schemes.</li><li>Supplemental proceedings such as arrest before judgment, security, temporary injunctions, receivers, and other interlocutory orders.</li><li>Compensation for arrest, attachment, or injunction obtained on insufficient grounds, up to two thousand shillings or the court’s pecuniary limit.</li><li>An alien friend, or an alien enemy residing in Uganda with the Minister’s permission, may sue in Ugandan courts; a recognised foreign State may sue to enforce private rights.</li></ul>
<h3>Appeals, Review, and Revision</h3>
You may appeal to the Court of Appeal against High Court decrees or orders unless the Act says otherwise. No appeal lies from a consent decree, but you may appeal an ex parte decree. A preliminary decree must be appealed separately; otherwise its correctness cannot be disputed in the final appeal.
<ul><li>Ordinary appeals from magistrates courts are heard by one High Court judge unless the Chief Justice orders more.</li><li>A second appeal to the Court of Appeal lies only on limited grounds: the decision is contrary to law, a material issue of law or usage was not decided, or a substantial procedural mistake affected the merits.</li><li>A third appeal from a magistrate grade II may lie only with certification of great public importance or where the Court of Appeal considers justice requires it.</li><li>No second appeal in suits with a value of one thousand shillings or less without special leave.</li><li>Appeals from orders are limited to those expressly listed, including certain arbitration orders, compensation orders, and orders imposing fines or arrest.</li><li>Every appeal must be filed within thirty days of the decree or order, or seven days of a registrar’s order, unless an extension is granted for good cause.</li></ul>
The same court may review its own decree or order in limited circumstances. The High Court may revise a magistrate court’s decision for lack of power, failure to exercise power, illegality, material irregularity, or injustice.
<h3>General Rules on Language, Time, and Court Powers</h3>
All courts must use English; evidence and written applications must be in English. Orders and notices under this Act must be in writing. Courts may summon assessors on questions of tribal or customary law or in admiralty cases; an assessor who fails to attend may be fined up to 200 currency points (UGX 4,000,000) and may be imprisoned for 15 days if the fine is not recovered.
<ul><li>If a decree is varied or reversed, the affected person may apply for restitution to be restored to the position before the original decree.</li><li>A surety’s liability under a decree or order may be enforced in the same manner as a decree.</li><li>A person under disability must act through a next friend or guardian, who needs the court’s leave for a consent or agreement.</li><li>Courts may extend time limits, allow payment of deficient court fees, correct clerical or accidental errors, amend defects in proceedings, and use inherent powers to prevent abuse of the court process.</li><li>The Finance Minister may amend the Schedule to the Act by statutory instrument with Cabinet approval.</li></ul>

You may sue in Uganda's courts as if you were a citizen of a Commonwealth country if you are an alien friend or an alien enemy residing in Uganda with the Minister's permission. You cannot sue if you are an alien enemy residing in Uganda without that permission, or if you reside in a foreign country. If you live in a foreign country that is at war with Uganda and you carry on business there without a licence under the Minister's hand, you are treated as an alien enemy residing in a foreign country for the purpose of the ban on suing. This means such a person has no access to Uganda's courts. The permission and licence requirements determine whether an alien enemy can bring a case.

Alien enemies residing in Uganda with the Minister's permission and alien friends may sue in Ugandan courts as Commonwealth citizens; other alien enemies can't.

Section 57: When Aliens May Sue in Ugandan Courts

Alien enemies residing in Uganda with the permission of the Minister, and alien friends, may sue in the courts of Uganda as if they were citizens of a Commonwealth country.

No alien enemy residing in Uganda without such permission, or residing in a foreign country, shall sue in any such courts.

Explanation — Every person residing in a foreign country the Government of which is at war with the Government of Uganda, and carrying on business in that country without a licence in that behalf under the hand of the Minister, shall, for the purpose of subsection (2), be deemed to be an alien enemy residing in a foreign country.
