11.Sound mind for purposes of contracting

(1)For the purposes of entering into a contract, a person is said to be of sound mind, if at the time of entering into the contract, that person is capable of understanding the contract and of forming a rational judgment as to its effect upon his or her interests.

(2)A person who is usually suffering from mental illness but occasionally of sound mind may enter into a contract during periods when he or she is of sound mind.

(3)A person who is usually of sound mind but occasionally suffers from mental illness may not enter into a contract during periods when he or she is suffering from mental illness.
