Police Act

<p>The Police Act (Chapter 324 of the Laws of Uganda) establishes the Uganda Police Force as the single national law enforcement agency. It defines the powers, duties, and structure of the police, as well as the rights and obligations of citizens. This Act applies to all police officers, special constables, local government police, and civilians interacting with the Force. Understanding this Act helps you know what to expect from police and how to exercise your rights.</p>

<h3>Key Definitions</h3>
<p>You must understand these definitions to know your rights and duties under the Act:</p>
<ul>
  <li><strong>Arrestable offence:</strong> Any crime punishable by at least one year imprisonment or a fine of five currency points (100,000 UGX).</li>
  <li><strong>Ranks:</strong> Inspector General, Commissioner, Constable, and others are clearly defined.</li>
  <li><strong>Police Force:</strong> The Uganda Police Force is the national police body.</li>
  <li><strong>Police Council and Police Authority:</strong> Oversight bodies with distinct functions.</li>
</ul>

<h3>Establishment and Composition of the Uganda Police Force</h3>
<p>The Act formally creates the Uganda Police Force (Section 2) as the sole national law enforcement agency. The Force comprises five groups (Section 3): the regular Uganda Police, the Uganda Police Reserve, special constables, local government police, and any other person appointed as a member. The Inspector General of Police commands the Force, assisted by a Deputy Inspector General, both appointed by the President (Section 5).</p>

<h3>Police Duties and Powers</h3>
<p>Police must protect life, property, and maintain order (Section 4). They have specific powers:</p>
<ul>
  <li><strong>Arrest without warrant:</strong> If you commit or are about to commit an arrestable offence (Section 23). For prevention of harm (Section 24).</li>
  <li><strong>Search:</strong> Police can search you or your property with reasonable suspicion of stolen goods (Section 26). They must follow rules: you have the right to be present, and a local leader should ideally attend (Section 27).</li>
  <li><strong>Seizure of property:</strong> Police may seize items that are evidence, and must give you a signed receipt (Section 30).</li>
  <li><strong>Traffic direction:</strong> You must obey uniformed police traffic directions or face a fine (Section 22).</li>
  <li><strong>Use of firearms:</strong> Police may only use firearms in extreme situations: to prevent serious harm, to arrest a felon who escapes, or when no other method works. They must give a warning and use reasonable force (Section 29).</li>
  <li><strong>Regulating assemblies:</strong> Police can control noise, routes, and timing of processions (Section 33). In gazetted areas, a permit is needed for assemblies of more than 25 people (Section 36). Unauthorized assemblies can be dispersed (Section 37) and participants face fines or imprisonment (Section 38).</li>
  <li><strong>Compelling witnesses:</strong> A senior officer can require you to provide information or documents (Section 28).</li>
  <li><strong>Instituting criminal proceedings:</strong> Police can start criminal cases in court (Section 32).</li>
</ul>

<h3>Your Rights When Dealing with Police</h3>
<ul>
  <li>If arrested without a warrant, you must be brought to court within 48 hours (Section 25). If not, you can apply to a magistrate for release.</li>
  <li>If you are female, only an authorised woman may search you (Section 23).</li>
  <li>During a search of your home, you have the right to be present and to see a warrant (Section 27).</li>
  <li>You can make a written complaint against a police officer for misconduct, such as bribery or oppression (Section 71). The complaint must be investigated, and you must get a report. False complaints are punishable.</li>
  <li>Bail bonds from police are free of charge (Section 39).</li>
  <li>If police seize your property related to a criminal case, you can apply to a magistrate for its return (Section 42). Unclaimed property is disposed of (Section 43).</li>
</ul>

<h3>Police Command and Oversight Structures</h3>
<ul>
  <li><strong>Police Authority:</strong> Chaired by the Minister, advises government, appoints senior officers (Sections 8-9).</li>
  <li><strong>Police Council:</strong> Chaired by the Inspector General, handles recruitment, promotions, discipline for ranks up to inspector (Sections 10-11).</li>
  <li><strong>District Police Committees:</strong> Advise on local appointments and personnel matters (Section 12).</li>
  <li><strong>Regional and District Command:</strong> Each region or district has a commander under the Inspector General (Section 7).</li>
</ul>

<h3>Police Employment and Discipline</h3>
<ul>
  <li><strong>Appointments:</strong> The Police Council sets procedures for ranks up to inspector; Police Authority for senior ranks (Section 14).</li>
  <li><strong>Retirement:</strong> Mandatory at 60; voluntary after 20 years of service; forced retirement for inefficiency or misconduct (with a right to be heard) (Section 15).</li>
  <li><strong>Resignation:</strong> Not allowed before 5 years of service; after that, written permission needed (Section 17).</li>
  <li><strong>Oath:</strong> All officers must take an oath before starting duty (Section 18).</li>
  <li><strong>Termination:</strong> On leaving service, officers must return all gear; failing is an offence (Section 19).</li>
  <li><strong>Disciplinary Code:</strong> Set out in Schedule 2, applies to all police officers, special constables, recruits, etc. (Sections 45-46).</li>
  <li><strong>Disciplinary Courts:</strong> Police Appeals Court, regional police courts, and subordinate police courts handle internal discipline. You have rights to appeal within 14 days (Sections 50-57).</li>
  <li><strong>Dismissal:</strong> For serious offences, dismissal can be recommended by a disciplinary court but decided by Police Authority or Police Council (Sections 48-49).</li>
</ul>

<h3>Special Police Forces</h3>
<ul>
  <li><strong>Special Constables:</strong> Appointed by the local police commander when extra help is needed; have same powers as regular police (Sections 65-66).</li>
  <li><strong>Police Reserve:</strong> Created by the Inspector General from retired officers of good character (Section 67).</li>
  <li><strong>Local Government Police:</strong> Work under the Inspector General, enforce local by-laws, and have same powers as regular police (Sections 68-69).</li>
</ul>

<h3>Welfare and Private Security</h3>
<ul>
  <li><strong>Police Welfare Fund:</strong> Fines collected go into this fund to support officers and their families (Section 62).</li>
  <li><strong>Private Security Organisations:</strong> The Minister can regulate their establishment and operations (Section 73).</li>
  <li><strong>Hiring Police for Private Duty:</strong> You can apply to the Inspector General for police officers on special duty, and you must pay the costs (Section 72).</li>
</ul>

<h3>Penalties and Offences</h3>
<ul>
  <li>Obstructing a police officer: fine up to 200,000 UGX or imprisonment up to 1 year (Section 21).</li>
  <li>Failing to obey a police order to disperse: the gathering becomes unlawful (Section 35).</li>
  <li>Unauthorised assembly or procession: fine up to 120,000 UGX or imprisonment up to 3 months (Section 38).</li>
  <li>Desertion: maximum 1 year imprisonment (Section 61).</li>
  <li>Harbouring a police officer on duty: fine up to 240,000 UGX or imprisonment up to 6 months (Section 70).</li>
  <li>False complaint against police: fine up to 240,000 UGX or imprisonment up to 6 months (Section 71).</li>

All police officers and other persons employed in the Uganda Police Force are subject to a Disciplinary Code of Conduct. This code is the basis for all disciplinary actions within the Force. The exact details of the code are set out in Schedule 2 of the Police Act. The Minister responsible for police affairs can change the code by issuing a statutory instrument, but only after consulting with the Inspector General of Police.

Section 45 of the Police Act (Cap 324) establishes a Disciplinary Code of Conduct for police officers and other Force employees, with amendment power by the Minister.

There shall be a Disciplinary Code of Conduct which shall be the basis for disciplinary control of all police officers and other persons employed in the Force.

The Disciplinary Code of Conduct established under subsection (1) shall be in the form set out in Schedule 2 to this Act.

The Minister may, by statutory instrument, in consultation with the Inspector General, amend the Disciplinary Code of Conduct.
