Registration of Titles Act

<p>The Registration of Titles Act, Cap 240, is Uganda's main law for registering land ownership and interests. It applies to anyone who owns, buys, sells, leases, or mortgages registered land. <h3>Who Does the Act Apply To?</h3>
<p>The Act applies to all registered land in Uganda. If you own land under a certificate of title, you are protected by this Act. <h3>How to Register Land</h3>
<p>To register land, you apply to the Registrar with the required documents, including a survey plan. The Registrar checks the application, publishes notices, and gives time for objections (caveats). If no one objects, the Registrar issues a certificate of title. Registration is official when the certificate is entered in the Register Book.</p>
<h3>Your Rights as a Registered Owner</h3>
<p>Once registered, your certificate is <strong>conclusive evidence</strong> of ownership. You hold the land free from hidden interests except those noted on the certificate or allowed by law (e.g., government reservations, public rights of way). You can sell, lease, or mortgage your land, but transfers must be registered to take effect.</p>
<h3>Buying Registered Land</h3>
<p>If you buy registered land in good faith and pay value, you are protected even if the seller obtained the title through fraud or error (unless you were involved in the fraud). You don't need to investigate how the seller became owner. Your title is secure.</p>
<h3>Caveats and Objections</h3>
<p>If you have a claim on land, you can lodge a <strong>caveat</strong> to prevent registration until your claim is resolved. Caveats lapse after 60 days if not enforced in court. Lodging a caveat without reasonable cause can lead to paying compensation for losses caused.</p>
<h3>Easements and Other Rights</h3>
<p>Easements (like rights of way) can be created on title using standard wording. They must be recorded on the certificate. Certain implied duties apply to leases, such as the tenant's duty to pay rent and keep the property in repair.</p>
<h3>When Things Go Wrong</h3>
<p>If you suffer loss due to fraud, error, or misconduct by the Registrar, you may claim compensation from the Government. However, you must act within six years of the loss. The Act also penalizes fraud – false statements or obtaining a certificate fraudulently can lead to up to three years in prison.</p>

Section 1: Key definitions for land registration in Uganda

In this Act, unless inconsistent with the context or subject matter—

"addition" means the description as to residence and profession, trade or occupation of any person;

"bankruptcy" includes liquidation of a company, and terms applicable to bankruptcy include terms applicable to the liquidation of a company;

"certificate of title" or "certificate" means a certificate of title issued by the Registrar under this Act;

"endorsed" includes anything written upon or in the margin or at the foot of any document;

"final mailo certificate" means a certificate by which the title of an African of Uganda to land is finally recognised;

"grant" means the grant by or on behalf of the Government of Uganda or a controlling authority under the Public Lands Act of land whether in fee or for years;

"encumbrances" includes all prior estates, interests, rights, claims and demands which can or may be had, made or set up in, to, upon, or in respect of, the land;

"instrument" includes any document in pursuance of which an entry is made in the register;

"land" includes messuages, tenements and hereditaments corporeal or incorporeal; and in every certificate of title, transfer and lease issued or made under this Act, "land" also includes all easements and appurtenances appertaining to the land described therein or reputed to be part of that land or appurtenant to it;

"letters of administration" includes, in the case of the estate of a deceased African of Uganda, a certificate of succession or other document from a competent authority declaring the right of any person to deal with that estate, and "administrator" includes that person;

"limited certificate" means a certificate limited as to parcels registered under <span class="underline-gradient ref-link" data-ref="240:39">section 39</span>;

"proprietor" means the owner whether in possession, remainder, reversion or otherwise of land or of a lease or mortgage whose name appears or is entered as the proprietor of that land or lease or mortgage in the Register Book;

"proprietor" also includes the done of a power to appoint or dispose of that land or lease or mortgage;

"Registrar" means the Registrar of Titles appointed under <span class="underline-gradient ref-link" data-ref="240:3">section 3</span> and includes the deputy registrar of titles so appointed and any assistant registrar of titles so appointed to the extent that he or she has been authorised to exercise or perform any power or duty conferred or imposed by this Act upon the Registrar of Titles;

"settlement" means any document under or by virtue of which any land is so limited as to create partial or limited estates or interests;

"surveyed" means surveyed, demarcated and delineated upon a map or plan to the satisfaction of the Commissioner Surveys and Mapping.

Interpretation

You have the right to rely on this Act for your registered land. Any other law that conflicts with this Act does not apply to your land, unless that other law explicitly says it overrides this Act. This Act also does not limit any existing laws that specifically protect married women's property rights. Those protections remain in full force.

Section 2: How conflicting laws affect registered land and married women's property

Except so far as is expressly enacted to the contrary, no Act or rule so far as inconsistent with this Act shall apply or be deemed to apply to land whether freehold or leasehold which is under the operation of this Act.

This Act shall not be construed as limiting or abridging the provisions of any law for the time being in force in Uganda relating specially to the property of married women.

Section 3: Appointment of Registrar of Titles and Support Staff

A Registrar of Titles shall be appointed to have the charge and control of the Office of Titles and to exercise the powers and perform the duties conferred or imposed upon the Registrar of Titles by this or any other Act.

There may be appointed a deputy registrar of titles and such assistant registrars of titles as may be required for the purposes of this Act.

The appointments made under this section shall be made in accordance with any written law relating to the appointment of persons in the public service.

Appointment of officers

All courts in Uganda must accept the signature of the Registrar as authentic without any need for additional proof. This means that when a document is signed by the Registrar, judges and judicial officers do not require further evidence to verify that signature. You have the right to rely on the Registrar's signature on land title documents as being genuine. This rule ensures smooth processing of registered land transactions and avoids delays from proving signatures in court.

Section 4 of Uganda's Registration of Titles Act requires courts to automatically accept the Registrar's signature as authentic without further proof.

Section 4: Courts Must Accept Registrar's Signature

All courts, judges and persons acting judicially shall take judicial notice of the signature of the Registrar.

Signature to be judicially noticed

The Registrar of Titles must keep an official seal marked with Uganda's coat of arms and the words "Office of Titles, Uganda". Any certificate of title or other document that appears to be sealed with this official seal and signed by the Registrar or Assistant Registrar can be used as evidence in court without needing extra proof of authenticity. This means you can rely on the document's appearance to show it is genuine, saving time and effort. Government cannot require you to bring additional witnesses or certificates to confirm the seal or signature on such documents.

Section 5: Official seal for land title certificates in Uganda

The Registrar shall cause to be kept a seal bearing the impression of the armorial ensigns of Uganda and having inscribed in the margin of the seal the words "Office of Titles, Uganda"; and all certificates of title and other documents purporting to be sealed with such seal and to be signed by the Registrar or Assistant Registrar shall be admissible as evidence without further proof.
