Section 91: Existing Rights for Leaseholders and Land Disputes

91.Existing rights

(1)A person whose lease had expired by the time of the coming into force of the Constitution and who had partially or fully developed the land, shall be entitled to a fresh grant upon application to the board.

(2)Where any case relating to a land dispute was pending before the High Court prior to the coming into force of this Act, that case shall continue to be heard by the High Court until completion.

(3)Where any case relating to a land dispute was pending before a magistrate's court or an executive committee court prior to the 2nd July, 2000, the case shall continue to be heard by the magistrate's court or the executive committee court until completion.
